SC orders Comelec to release partylist nominees

Excerpts: MANILA, Philippines -- The Supreme Court has ordered the Commission on Elections to immediately disclose the partylist nominees.

In a consolidated decision penned by Associate Justice Cancio Garcia, the High Court also ruled that it was the responsibility of the Comelec to determine the qualifications of the partylist groups.

On the issue of releasing the list of nominees, the high tribunal agreed with petitioners Akbayan and Kilosbayan that non-disclosure was against the public’s right to information, which violated Article 2 and Article 3 of the Constitution.

The high tribunal cited Article III Section 7 of the Constitution, which provided &quot;the right of the people to information on matters of public concern shall be recognized…&quot;

It also pointed to Section 28 Article II of the Constitution which provided that &quot;Subject to reasonable conditions prescribed by law, the State adopts and implements a policy of full public disclosure of all its transactions involving public interest.&quot;

The High Court said, &quot;The people have the right to elect their representatives based on an informed judgment.&quot;

The high tribunal gave the Comelec five days upon receipt of the decision to provide the court copies of the nominees.

The court ruling on the Comelec’s role in determining the qualifications of partylist groups was sought by Bantay Republic 7941 and Urban Poor for Legal Reforms.

In their petition, the two told the High Court that the Comelec had violated the eight-point guidelines it had set to determine which organizations were qualified as partylist groups.

The court said determining the qualifications dealt with factual issues, which the Comelec was in a position to decide.</description>

Sino ang sexist? excuse me po, pero tila Babae ka yata yon. Babae ka nga ang pangalan pero wala naman ginawa para sa interes na kababaihan. sagutin na lang ninyo tanong ni violent dispersal kung nasaan grupo ninyo sa iba&#039;t ibang isyu tungkol sa kababaihan na wala kayong ginawa at pagtugon bukod sa magpapirma para sa cha-cha ni GMA.

Alam ninyo, kahit isang milyon pang Press releases, statements at blogs ang likhain ninyo hindi na ninyo maitatanggi na sindikato kayo ng Malacanang, patakbuhing tuta ng OEA at mga bayarang grupo. Hindi bobo ang masa, alam nila kapag peke ang isang grupo at nanlalansi.

		<description>I just strayed in this area now and saw that Parents Enabling Parents (PEP Coalition) is included in the BOGUS Party-list. PLEASE, for clarification and fair media exposure, PEP is NOT A BOGUS OR FRONT Party-list. We (where I am just an ordinary parent volunteer), the parents, have come to form this coalition out of frustration for the system that is existing in this country. The system where ONE IS A NOBODY UNTIL ONE IS HEARD in any means! When i say any means, i mean either one goes by way of the &quot;fair-and-square&quot; or &quot;pay-and-play&quot;. We prefer to play but win fair and square!</description>
